Man arrested for sexually assaulting woman he met at restaurant

A man has been arrested after he sexually assaulted a woman he met at a Waco restaurant in early May, an arrest affidavit says.

Officers interviewed the victim at the hospital the day after the incident. The victim told officers she and a friend met 35-year-old Luis Daniel Vega at a restaurant when she became intoxicated to the point of vomiting. 

When she left, she went to a motel with the man, where the incident occurred.

The affidavit said the victim, her friend and Vega gave different accounts of the events leading up to the reported assault.

The victim reported she was so intoxicated that she was not aware of her surroundings, the affidavit said. She said she woke up to Vega sexually assaulting her. The victim added she consistently said she was too intoxicated to give consent.

During the first interview, Vega said the victim was fully awake and engaged in consensual sex. But during a second interview, he contradicted his statements. 

Vega admitted that the victim fell asleep several times during the incident and was "sleepy" due to her intoxication. He also made statements that the victim was too intoxicated to make responsible decisions, the affidavit says. 

Vega was then charged with sexual assault on May 25. He was brought to McLennan County Jail where his bond has not been set.
