Family of motorcyclist files wrongful death lawsuit

The family of a motorcyclist who was killed in an accident last summer filed a wrongful death lawsuit against the driver who hit him.

The family of Taylor Ryberg, 49, filed the lawsuit in McLennan County’s 170th District Court.

On August 29th, 2015, Taylor Ryberg was riding his motorcycle on Valley Mills Dr. in Waco when he was hit and killed by an SUV.

The lawsuit claims the driver of the SUV, David Fallas, made a right turn from the middle lane into the O'Reilly Auto Parts parking lot, turning directly in front of Ryberg, causing the accident.

According to the lawsuit, Fallas’ SUV dragged Ryberg about 50 feet into the parking lot of O’Reilly Auto Parts.

Police said Ryberg was not wearing a helmet.

The lawsuit states Ryberg suffered massive injuries but was conscious for about 30 minutes before he died at the hospital.

According to the lawsuit, Fallas was negligent in his driving by failing to “exercise ordinary care in the operation of the SUV,” by making a right hand turn from the center lane, by failing to signal his intention to leave the middle lane, and by failing to keep a properly lookout for Taylor Ryberg, deceased, in the right hand lane.”

The suit also names Fallas' company, Fallas Automation Inc., because he was driving an SUV owned by the company.
