City of West blamed for explosion in court motion

WEST, TX (KXXV) - A new motion filed by defendants in the trial after the West explosion say the city of West and others are liable for the explosion. 

CF Industries defendants filed a motion to designate responsible third party Friday. In it they denied liability against themselves and say the city of West, Adair Grain, Inc., Textron Company and the criminal acts of John Doe contributed to the explosion. 

The motion says CF Industries, who supplied the ammonium nitrate to the West Fertilizer Plant Adair grain, is not liable. It then goes on to say the city is liable because of an investigation by the Texas State Fire Marshal. That report says West firefighters were not properly trained to handle a fire including the dangerous chemical. So, the motion says because the city is responsible for training the fire department, the city is liable. 

An ATF investigation in May, 2013 also listed the causes of the explosion. It said it could have been caused by electrical wiring, a golf cart or the criminal actions of a person. That's why the motion lists Adair Grain, Textron Company (the manufacturer of the golf cart) and John Doe as liable third parties. 

“The manufacturers of the fertilizer that blew up half the town of west, killed 15 people, injured hundreds and destroyed homes and businesses have blamed the explosion and damage on the west volunteer fire department, a golf cart manufacturer and an imaginary criminal person... some things really just don’t need any comment," City of West's attorney Steve Harrison said. 


CF Industries' attorneys would not comment on the motion. 


Harrison says they're currently taking depositions or interviewing witnesses. The first of three group trials is set to start July 27, 2015.
