WACO - The man accused of killing two men at a Waco apartment on May 13 has now been charged with aggravated assault for an incident that police say happened 5 hours before the Waco double murder.

Todric McDonald was served with an aggravated assault warrant on Wednesday. Tony Olivarez, 29, was also arrested by the U.S. Marshal Task Force in connection with assault.

According to police, McDonald and Olivarez got in a fight with a 31-year-old man in the 2300 block of Morrow, shortly after 11 p.m. May 12. The two went to the victim's home and were let in, as the victim knew at least one of them.

A fight started while the three were in the home. During the fight, McDonald and Olivarez are accused of firing shots inside the home and at the victim. The victim was able to escape without getting shot. McDonald and Olivarez fled the scene in a vehicle.

On top of the capital murder charge, McDonald has also been charged with aggravated robbery for an incident on May 10, where police say he pulled a gun on a man and stole his vehicle.
