West ISD files lawsuit, seeks millions

WEST - West ISD is fighting for millions of dollars they feel they deserve from their insurance company. It is money they were supposed to receive as a result of the West Fertilizer Plant Explosion. West superintendent Marty Crawford says they have talked to the insurance company long enough, and now action must be taken.

"Our interactions with our insurance company have plateaued so it was time to hand it over to the experts and let them hash it out," Crawford said.

The school district has already been granted $30 million from the Argonaut Insurance Company, but school officials say that the damage done to their four schools was far more than that. On Tuesday, the Gravely & Pearson law firm from San Antonio filed the suit on the school district's behalf. It claims the Argonaut Insurance Company refused to fully compensate the school district.
      
West ISD is now seeking roughly $23 million in addition to the $30 million they are owed.

According to the 13-page lawsuit the school district's insurance policy should have covered all their campuses if they were damaged by a fire and explosion. On April 17, 2013, West High School and West Intermediate School were destroyed from the fertilizer plant explosion, and the middle school received significant damage as well.

Crawford said if they do not get the money they are owed, it could affect taxpayers.

"For every cent that we can grab through our proof of loss our insurance we feel that we are owed in our covenant with our insurance company that is less money than the federal government is going to have to give us," Crawford said.

Crawford said this pending lawsuit will not affect construction of the new West High School and West Middle School.

Trident Insurance Services and the Texas Association of Public Educators are also included in the lawsuit for various reasons. Argonaut Insurance Company said they do not have a response to the lawsuit at this time.
