MCLENNAN COUNTY -
BREAKING: A McLennan County jury has sentenced Carnell Petetan Jr. to the death penalty for capital murder.

We will have more on this sentence coming up on News Channel 25 at 5 and 6.

Both sides have rested in the punishment phase of Carnell Petetan's capital murder trial, leaving the final summation for Tuesday morning.

Last week, a jury decided he is guilty of killing his wife.

Prosecutors are doing everything they can to make sure Petetan gets the death penalty.  The trial is now in its third week and prosecutors called 10 witnesses Monday alone.

Jurors heard from a variety of people from Petetan's past, ranging from teachers to inmates to several folks from the Texas Department of Criminal Justice.

It's clear the state is trying to prove that Petetan is not mentally retarded and that he would likely commit criminal acts of violence in the future.

Petetan's first grade teacher referred to him as wise and said if he's retarded, then he's "smart retarded".

One prison employee told jurors how, despite tough security, he found handmade weapons in Petetan's cell.

An inmate recounted the day Petetan stabbed him while they were in prison together.

A gang expert went over Petetan's tattoos, including the one on his chest (picture on the right), and said they suggest he's a member of the Crips.

Before wrapping up, prosecutors read letters written by Petetan, trying to prove to the jury that Petetan is much smarter than the defense is making him out to be.

Again, the final summation will start Tuesday.  After that, Petetan's fate is in the jury's hands.
