Petetan found guilty of capital murder, faces life in prison or death penalty

WACO - UPDATE: The jury has found Carnell Petetan guilty of capital murder. He is facing either life in prison or the death penalty. The sentencing phase will begin Tuesday, April 22. 

Petetan took the stand Monday, even though his attorneys advised against it. Regardless, Petetan said a fair trial should include his side of the story.

He says his friend shot and killed his wife Kimberly and that he is innocent. Petetan says he's not remorseful, because he is not guilty.

When prosecutors pointed out that Petetan's story conflicts with every other person who testified - Petetan said they are all lying. 

An inmate who served time with Petetan also testified today.  He said Petetan admitted to killing Kimberly. 

 By noon, both sides were done calling witnesses and closing statements started after lunch.

Prosecutors said Petetan is a killer and full of garbage.  They said he is also guilty of burglary, kidnapping and retaliation. 

But defense attorneys say police were not open minded when they arrested and questioned Petetan because of his criminal history and scary appearance.  They also said the witnesses stories did not add up.

In order to find Petetan guilty of capital murder, the jury must also find him guilty of burglary, kidnapping and/or retaliation.

Prosecutors are asking for the death penalty.
