Family of construction worker files lawsuit for bridge death


The family of the construction worker who died while working on the pedestrian bridge for the new McLane stadium has filed a lawsuit. They have not only listed Baylor University and the general contractor on suit, but five other companies as well.

The family's attorney, Vuk Vujasinovic, says their main goal right now is to find who is responsible for the accident.

"The family has no idea how or why this happened other than allowing us a very limited inspection and giving us one set of photographs neither of which answers the family's question," Vujasinovic said.

On January 28th, Jose Dario Suarez was attached to a boom lift  while working on the pedestrian bridge for the new McLane Stadium. The boom lift fell into the Brazos River and sunk. Suarez was not able to detach himself from the lift and drowned in the river.

The Suarez family attorney says this tragic accident should have never happened.

"Once we see what OSHA's report is. We can hold the responsible parties accountable for what happened because a boom lift is not supposed to fall in the Brazos River and sink with two man tied off to it," Vujasinovic said.

OSHA is continuing to investigate the accident, but the family's attorney says that not until they know who is responsible for the accident they have no choice but to file a lawsuit against everyone.

"Folks with the construction companies or Baylor...indicated to us that they felt there was a problem with that equipment and that we should sue them as well," Vujasinovic said.

Austin Construction says they would not comment on the lawsuit at this time, but they offer their condolences to the family.

Baylor University says the accident is a terrible tragedy and they too have the family in their thoughts, but as of Wednesday afternoon they still haven't seen the lawsuit.

The attorneys are also suing Austin Bridge & Road, LP, Austin Bridge & Road, Inc., Derr & Isbell Construction, LLC, Genie Industries and Flexifloat Construction Systems.

Vujasinovic filed the lawsuit in Harris County, and says there were many reasons for the decision.

"One consideration is who is going to be on the jury, and as counsel for the family it is up for us to decide what the best place for this family's lawsuit is. As the people who filed the lawsuit, we and the family have the right to chose where to file the case," Vujasinovic said.
