Judge: Environmental group fails to prove local coal plant violations

WACO - A federal judge says an environmental organization failed to prove that a Freestone County coal plant violated the Clean Air Act.

The Sierra Club had claimed that the Big Brown Steam Electric Station polluted and endangered the ecology in the surrounding area.

The Sierra Club called an expert witness on Monday to back their claims that the Big Brown Steam Electric Station Plant has violated and continues to violate the Clean Air Act.

They maintain it has violated state and EPA standards more than 6,000 times since 2007.  

The expert witness testified the plant's control devices are too small to handle the amount of emissions and alleges the company has known that since 1997 based on third party contractor reports.

The Sierra Club is suing the plants owners, Energy Future Holdings Corporation and Luminant Generation Company for polluting the air and keeping neighbors from enjoying the outdoors and endangering the ecology of the region.

Both sides gave their closing arguments, before hearing the judge's decision on Wednesday.

In the end, the judge said the plaintiffs were not able to prove any violations over the course of 7 years.
