Fertilizer "middle man" named in West lawsuits

Oklahoma based fertilizer companies are now named as defendants in the lawsuits after the West explosion.  

In a revised petition released this week, attorneys representing those affected by the explosion say the middle man is liable.

The petition says ISB Industries, El Dorado Chemical Company and Thermaclime Inc. are all liable for the explosion. These Oklahoma based companies are listed under the same agent David Shear and supplied the West fertilizer plant with the ammonium nitrate based fertilizer.

The companies bought the fertilizer from CF Industries which is a national company that was named in the earlier petition. They then sold it to Adair Grain Inc., which owns the West fertilizer plant.

The petition says these "El Dorado Defendants" had a liability to make sure the fertilizer was stored properly. It also alleges they did not use an additive which could have prevented an explosion.

CF Industries and International Chemical Company face the same allegations. Adair Grain Inc. is also accused of not storing the fertilizer properly.

The first of three trials is set to begin in January of 2015 in McLennan county.
