Waco police make second arrest in October 2013 murder case

WACO - UPDATE: Texavia Rashun Ervin has been released from jail as Waco police continue to investigate the alleged crime, but Byrd remains behind bars on a parole hold.

McLennan County District Attorney Abel Reyna says the direction of the investigation has changed since the two men were arrested.

In a mutual agreement, the DA's Office and Waco PD determined this case needs to be investigated further before it's presented to a grand jury.

A second suspect has been arrested in connection with the murder of David Lee in October 2013.

23-year-old Texavia Rashun Ervin was arrested about 12:30 p.m. Tuesday afternoon by the U.S. Marshal Task Force. Ervin was arrested without incident in the 3200 block of N. 25th St. He was later transported to the McLennan County Jail.

Ervin is the second of two suspects police believe was involved in the murder of Lee.
Police arrested a 23-year-old man Monday afternoon who was also wanted for the capital murder case.

Danny Lee Byrd Jr. was wanted on a capital murder warrant that was obtained by the Special Crimes Unit for the death of Leslie David Lee, 44.

The U.S. Marshal Task Force arrested Byrd Monday afternoon in the 1900 block of Reuter. He was later taken to the McLennan County Jail.

Police say Leslie David Lee was murdered Oct. 26, 2013 in the 2500 block of Ethel Ave., in what police say was an apparent drug deal gone bad.

This case is still being investigated by police. No further information is expected to be released at this time.
