Waco daycare operator indicted on multiple counts, including murder

WACO - The Waco daycare operator accused of giving a child a lethal dose of Benadryl, has been indicted on multiple counts, including one count of murder.

The McLennan County Clerk's Office says a Grand Jury indicted Marian Bergman Fraser on one count of murder and one count of injury to a child causing serious bodily injury on one indictment. There are also 10 separate indictments, each for a count of endangering a child.

Fraser is accused of giving Benadryl to children at her daycare, one of whom died of an overdose in March 2012.

The prosecution of Marian Fraser is being handled by the Tarrant County DA's Office after McLennan County District Attorney Abel Reyna chose to recuse his office from handling the case for various reasons.

4-month-old Clara Marguerite Felton of Waco died March 4. According to police, her cause of death was determined to be from toxic levels of Diphenhydramine (Benadryl) in her system. Police believe the baby was given Benadryl to keep her asleep during nap time.

Fraser was arrested in August on a charge of injury to child causing death, a 1st degree felony. She then received two additional warrants for endangering a child for two additional children.

Eight additional warrants were issued for Fraser after eight more children at her daycare tested positive for Benadryl.
