Master complaint alleges CF Industries liable for West explosion

Court documents filed late Friday afternoon alleges CF Industries and Adair Grant are liable for the West explosion.

This master complaint (click here for the full document) was filed Friday afternoon just after 5:00. It goes through multiple allegations of liability for CF Industries, a national company which manufactured the ammonium nitrate, and Adair Grain, which owned the fertilizer plant in West.

The complaint encompasses all allegations from multiple plaintiffs ranging from those who lost family members, were injured, lost homes and the city of West.

The petition says CF industries was negligent when providing the fertilizer to the West plant. It says they did not warn the plant about the dangers of the ammonium nitrate. It also says they did not make sure it was being stored properly.

The petition also says they provided an unreasonably dangerous product. This is because there are products available which diminishes the possibility or eliminates the possibility of explosion while in storage. This, however, was not used.

The complaint also says Adair Grain is liable because they were negligent in storing the nitrogen based fertilizer.

News Channel 25 reached out to attorneys representing CF Industries and they only said they do not comment on pending litigation.

If  those liabilities are proven in court, multiple people will ask for millions in damages ranging from property damages, injuries and wrongful death. Plaintiffs' attorney Stephen Harrison, who represents multiple people and the city of West, says they will have three separate trial groups. Those will include several people who are asking for damages.

The first trial group will be on January 26, 2015, the second on April 27, 2015 and the third on July 27th, 2015. Harrison says those trials could take up to five weeks.

There is still a lot of research yet to be done leading up to the trial. Harrison says depositions will start in Chicago next week for CF Industries.
