Man facing death penalty to have competency hearing

A man facing the death penalty will find out if he'll even go to trial.

Carnell Petetan Jr. is charged with capital murder and kidnapping from a case back in September 2012. On Tuesday he has a competency hearing to figure out if he's able to go to trial.

Police say Petetan shot and killed his ex-wife and then took their 9 year old daughter. The girl was later found with family. A day later Bryan police picked up Petetan after a traffic stop.

Thursday's hearing will decide whether he's capable to go to trial. Defense attorney Walter Reaves Jr. says he asked for the hearing because he doesn't think Petetan has the ability to consult with a lawyer and help in his defense.

Reaves says he will call on a psychologist to testify in the hearing where the defense has the burden of truth. A McLennan County jury will then decide if Petetan is competent or not with the decision coming either Tuesday or Wednesday.

If he's not, then two things could happen. He could either be incompetent with the chance of rehabilitation or incompetent with no chance of rehabilitation.

If he is found competent, Petetan's trial could start around the start of March. Petetan will face the death penalty.
