Grand Jury clears officer of March shooting that injured two


A McLennan County Grand Jury has no billed a Waco Patrol Officer in connection with a shooting that injured two back in March.

Francisco Reyes was involved in a shooting in the 2000 block of Lyle Ave. on March 18. Police were called out to the scene after receiving a call about a fight between Alexander Howard Mendoza and his girlfriend.

According to police, when authorities arrived, 19-year-old Mendoza was armed, and allegedly tried to level a rifle at an officer in a threatening manner. Mendoza was shot in the stomach and rushed to Hillcrest Baptist Medical Center. Mendoza was indicted on two counts of aggravated assault against a public officer for his role in the shooting.

Mendoza's grandfather, Tommy Gene Smith, had been struggling with Mendoza when the shot was fired and his hand was injured. It was initially reported that police were not sure what caused the grandfather's hand to be injured, but police later confirmed that the grandfather's broken hand was caused by officers. 

Waco police say six-year patrol officer Francisco Reyes shot in self-defense.

There was some controversy surrounding this case as Waco PD investigated the shooting instead of a third party.

The family has also filed a federal civil lawsuit against Reyes and the city that alleges officers used excessive force. Smith's attorney claims the officer used a "shoot first, ask questions later" approach.
