Tarrant County DA's Office to handle prosecution of Marian Fraser


The case of the day care owner accused of giving a child a lethal dose of benadryl will not be handled by the McLennan County District Attorney's Office.

The prosecution of Marian Fraser will be handled by the Tarrant County DA's Office.

Fraser faces ten counts of endangering a child and one count of injury to a child causing death.

McLennan County District Attorney Abel Reyna, says there were various reasons why he chose to recuse his office from handling the case.

One of those reasons is that Reyna knows the parents and works with a grandparent of the 4-month-old who died.

"The whole idea regardless of the factors is you want to avoid the appearance of impropriety," said Reyna. "You want to ensure that the individual receives a fair trial and you don't want to do anything to jeopardize that even if it looks like you might. You don't want that."

As of now, Fraser's trial will still be in McLennan County, but Tarrant County DA's Office will have the final say.
