Coryell DA won't seek death penalty for David Allen

A former pastor accused of killing his wife will not face the death penalty.

David Keith Allen is charged with capital murder, accused of killing his wife, Paula Allen, in a mobile home fire in Gatesville in March 2011.

Coryell County District Attorney Dusty Boyd announced Friday he will not seek the death penalty when the case goes to trial later this year. Former DA David Castillo had previously made the notice of not seeking the death penalty, but Boyd said he wanted to take a second look when he took office in January. After going over the case, Boyd says he will not seek execution.

"Based on the interviews and the people that we visited with in the interested folks in the community, whether that be people that knew Mr. Allen, or the people that knew Paula," Boyd said. "Specifically and especially the family, this was the decision that was made."

This pre-trial comes after charges of Allen's current wife, Megan Allen. She's accused by a grand jury of lying about her relationship with Allen months before the fire in 2011. She's charged with aggravated perjury, a third degree felony.

"It is absolutely vital that the truth comes out because this is how this process works. It's a truth finding process and if someone attempts to subvert that or to avoid that then there is consequences for it," Boyd said.

Megan Allen has been released from jail on a $50,000 bond. Boyd says David Allen could have another pre-trial in late July. His trial is set for November 18.
