Military judge speeds through outstanding motions during Hasan hearing

Posted:

Accused Fort Hood Shooter Maj. Nidal Hasan was back in court today.

With little objection from Hasan, the court was able to hear all but two outstanding motions.

Judge Col. Tara Osborn ruled that the voice recording of Pfc. Francheska Velez crying out "My baby, my baby," will be able to be used during trial. However, the court is unclear if they will allow the prosecution to use the e-mails Hasan sent to popular Islamic Radicalist Anwar al-Awlaki.

In a response to prosecution attorney Col. Steve Henricks, Judge Col. Osborn said the e-mails could interfere with Hasan's right to due process because the e-mails could cause unfair prejudice by special association.

Additionally, the judge ruled that both parties will be allowed to conduct voir dire and individually question panel members.

Hasan also requested that Dr. Jeffery Frederick, jury panel selection expert, to be present at the defense table during panel selection.

Panel selection is set to start on July 9, with a trial start date of August 8.

The next hearing will be held on July 2. Hasan will enter a plea deal at that time.
