Families on both sides shed tears Thursday night after Tomas Ramirez was found guilty on four of five counts on the indictment.
36 year old Tomas Ramirez was charged with five counts: three counts of aggravated sexual assault of a child and two counts of indecency with a child by contact. A Waco jury found Ramirez guilty Thursday on two counts of aggravated assault and both counts of indecency.
The third day of the trial started with the state giving its final witness. A psychologist testified concerning the mindset and motives of both a child who's been sexually abused and the abuser.
The defense then had its chance and asked the judge for time to find new evidence. However, the defense did not call anymore witnesses and rested shortly after 1 p.m.
In closing arguments the defense reminded the jury that Ramirez is innocent until proven guilty. Ramirez's attorney also said that looking back on the alleged victim's childhood, it can be easy to see the signs of abuse. However, he says it can be dangerous took look back with that perspective.
In the prosecutor's closing arguments, the state argued that if you look at the whole picture, then the signs do point to the alleged victim being abused. The prosecutor also said the woman had no motive to lie.
The jury went to deliberations shortly after 2:30. After nearly four hours, the jury came back with the guilty verdicts on four of the five counts.
Those counts come from the five separate occasions she was abused by Ramirez that the victim testified to on Wednesday.
On the two counts of aggravated sexual assault of a child Ramirez faces five years to 99 years or life. On the two counts of indecency with a child Ramirez faces two to 20 years in prison and up to a $10,000 fine.
Those sentences would be concurrent, meaning Ramirez would do time for both sentences at the same time.
The punishment phase will begin Friday morning at 10. Indictments also include six more children allegedly molested by Ramirez. The same jury will see those trials as well.
