Federal agents bust Harker Heights family medicine clinic

Federal agents bust Harker Heights family medicine clinic

Harker Heights--Family Medicine Clinic, also known as FMC, was busted by federal agents for making false claims for payment to the TRICARE, Medicare and Medicaid programs. TRICARE is a federally funded medical benefits program for military personnel and their families. United States Attorney Robert Pitman says Dr. Bola Elemuren and her husband John Ogunmuyiwa agreed to pay $430,000 to settle those claims.

Agents with the Department of Defense Criminal Investigative Service found that between 2003-2008, both knowingly over charged TRICARE for automated Gynecology-related laboratory tests. The particular test must be billed under an inclusive billing code at a pre-determined rate. However, Dr. Elemuren and office manager Ogunmuyiwa inflated those charges by separately billing the test under multiple CPT codes at a higher total cost to the TRICARE program. Investigators say the couple submitted those procedures as if more than one test was performed. By doing so, it appeared that they were entitled to more than one payment from the government.

From 2008-2012, FMC also knowingly billed TRICARE, Medicare and Medicaid for diagnostic x-rays that were performed by unqualified and improperly trained personnel. Pitman added that the $430,000 settlement is not an admission of liability by Dr. Elemuren and Ogunmuyiwa.
