Three more men are awaiting capital murder trials after the first defendant, Rickey Donnell Cummings, was sentenced to death on Wednesday for the 2011 double-murder.
Tyus Sneed, 17, and Keenan Hubert, 20, were killed when gunfire sprayed the car they were sitting in at Waco's Lakewood Villas on March 28, 2011. Deontrae Majors and Marion Bible were able to escape the car but were wounded.
Darvis Tyrell Cummings, Kevin Wayne "Kennedy" Hardaway and Albert Leslie Love, Jr. were arrested last year. Each is facing capital murder and two counts of attempted capital murder.
Darvis is Rickey Cummings' brother, Hardaway is their cousin, and Love is their close friend, documents stated.
Affidavits for Darvis Cummings' arrest warrant say Rickey sent Darvis instructions by text message minutes before and after the shootings. Records showed their cell phone signals were of the same radio frequency and the same cell tower closest to the Spring Street double-murder scene.
According to the documents, Waco Police responding to the murder pulled over Darvis Cummings driving away from the scene. A pistol was found in his car.
An affidavit for Hardaway's arrest states that a witness identified him as being at the scene and running away while carrying a handgun.
Witnesses reported they saw about five men, one of whom they recognized as Rickey Cummings, in hoodies at the scene and at least three carrying guns. One saw Rickey Cummings chasing the two survivors trying to shoot at them with his handgun.
Another confidential witness reported seeing Love carrying an A-K 47. That witness identified Love in a line-up of photographs.
Investigators found at least 20 bullet holes in the victims' car. Most, if not all, appeared to be from an A-K 47 or an SKS rifle.
Witnesses requested to remain anonymous in the 2011 reports because of death threats against them.
Trial dates have not yet been set for any of the accused.
