Testimony begins in trial of man accused of manslaughter

WACO - A Waco man is on trial for killing a woman in a fiery car crash just over one year ago and the prosecuting attorneys believe drugs may have played a role in that accident.

Jacob Scott Turner is facing charges of enhanced manslaughter after he rammed Peggy Cantrell's car at the intersection of Bosque Blvd. and New Rd. in June 2011.

The trial is for enhanced manslaughter, instead of regular manslaughter, because Turner had a previous felony conviction of illegally obtaining prescription drugs.

Coincidentally, the prosecution is trying to link the car accident to drugs. Witness testimony Tuesday afternoon showed Turner had small amounts of morphine, a key ingredient of heroine, in his blood at the time of the accident. Investigators also said they found a spoon with traces of heroine on it in Turner's car at the scene of the wreck.

In order for Turner to be found guilty of manslaughter, the prosecution must prove he was either under the influence of drugs or was driving recklessly when he collided with Cantrell's car.

One witness testified that based on the wreckage of the car accident that Turner was likely driving at a quote "highway rate of speed."

More witness testimony showed Turner called his own mother after the accident instead of reporting it to police first. Turner was on his way to his mother's house when the accident happened according to witnesses.

Family members of Cantrell and Turner were in the courtroom Monday to watch the trial.

Turner is facing anywhere between five years to life in prison if he is found guilty because it is an enhanced charge. Normally someone in a manslaughter case would only face two years to twenty years of sentencing.

The trial will continue Wednesday morning with more testimony from the prosecution's witnesses.
