Decision reached in Patricia Rush trial

WACO - Patricia Rush, the woman accused of carrying on a sexual relationship with her 13-year-old student back in 2007 has been found "not guilty" on 10 of the charges against her. The jury was unable to reach a decision on the other 8 charges, so the case was declared a mistrial.

The jury began deliberating just before noon on Friday and was able to reach an agreement on the first 10 charges. But after more deliberation on Monday, they sent out notice that they were hopelessly deadlocked.

During the closing arguments on Friday, Rush's lawyers said the alleged teenage victim was not a credible witness.

Prosecutors argued back that Rush corroborated every part of the story with the exception of the parts that would get her into trouble (the sexual encounters).

The two had apparently talked on the phone 46 times for more than three and a half hours in one day alone. The defense admitted that it was wrong of Rush to send these messages, but said it didn't suggest anything illegal.

A decision must now be made on whether Rush will be retried on these 8 charges.
