Major Nidal Hasan to face death penalty

by: Aimee Burnett and Christine McCarthy

FORT HOOD - Lt. General Donald M. Campbell, Jr. has decided Maj. Nidal Hasan is going to stand trial for the deadly shootings on post back in November of 2009, and, if convicted by a military jury, he could face the death penalty.

A military judge will now take over the case, and that judge will most likely first set an arraignment date for Hasan.  No military judge has been named to the case yet.

Hasan's attorney, John Galligan, says he is upset he was not given proper notification that his client was going to receive court marshal papers this morning, but he happened to be at the jail at that time.

Galligan says the army has "brought in special prosecutors from Washington and they want to kill [his] client."

Hasan is accused of opening fire at the Soldier Readiness Center on November 5, 2009, killing 13 people and wounding 32 others.

He faces 13 counts of premeditated murder and 32 counts of attempted murder.
